Justice Yashwant Varma’s resignation midway through the impeachment process has exposed a major deficiency of the process prescribed under the Constitution to remove a judge of the high court. However, it is not a design flaw with the process. The flaw has been created by later decisions, which have weakened the process of impeachment as a tool for accountability. Reverting these decisions may be necessary to strengthen the impeachment process. –Reproduced
