The existing criminal justice system of the country has been suffering from cetain maladies resulting in a wide performance gap on a persistent basis. Lack of coordination between police and prosecution is one of the major handicaps it faces, besides want of professional capability and competence of police personnel in crime investigation. This is reflected in the poor rate of conviction in criminal offences. Moreover, the existing accused-oriented system needs to be replaced with a victim-oriented one, and for this, the burden of proof should lay with the accused. The existing criminal justice system in India, which remains by and large a colonial legacy, needs radical reforms to make it effective in the fight against deep-rooted corruption in our society. - Reproduced. |
