Rule of law: a sine qua non for good governance - 2017 - p.10-18. - Oct

This paper seeks to explain the relationship between rule of law and good governance in the context of the historical experience of societies in organising political power for maintaining order, justice and progress. It particularly focuses on Indiaメs experience with rule of law, which is part of the basic structure of the Indian constitution and is characterized by limited government, guarantee of basic rights and an independent judiciary. While appreciating the critical role of the judiciary in upholding the rule of law, the paper sounds a word of caution against judicial overreach. It emphasizes the complementary role of other constitutional institutions and the need for alignment of the principle with major social goals. - Reproduce
