Perils of law: Trans subjectivities at the limits of legality - Economic and Political Weekly - 60(43), 25 Oct- Nov 1, 2025: p.41-46

The Navtej Singh Johar (2018) verdict, which decriminalised Section 377 of the Indian Penal Code, emerged from decades of sustained struggle by queer activists in India. This article, however, moves beyond the framework of decriminalisation to critically examine two other significant developments—the National Legal Services Authority v Union of India judgment (2014) and the Transgender Persons (Protection of Rights) Rules, 2020. It traces the formation of trans subjectivities within these legal and legislative discourses. Further, the article analyses responses from transgender activists to these interventions, thereby interrogating statist definitions of trans and gender non-conforming identities.- Reproduced
