However, a closer look at the empirical data reveals a different reality. To address the arguments of this alleged misuse, this paper provides a considered analysis of data related to key indicators for cases registered under sections related to domestic violence. The findings highlight gross under-reporting and methodological errors in data collation by the National Crime Records Bureau, which inadvertently aid the argument of “misuse.” A comparison of the data at the national and city level for Bengaluru reveals a stark difference in conviction rates, indicating systemic issues. These data gaps limit our understanding of domestic violence and the related laws and schemes to counter it from an intersectional perspective.
