520 _aThe Constitution guarantees special provisions for Scheduled Tribes/Indigenous Peoples/Adivasis in Fifth Schedule areas under Article 244(1). Constitutionally, these provisions are designated to ensure the security and protection of Indigenous Peoples. However, despite such stringent protective measures, post-independence-era development in the Fifth Schedule areas has been marked by massive land acquisition, displacement, resource exploitation, and socio-economic and political exclusion of Indigenous Peoples. This paper examines the trajectory of such adverse development and seeks to explore alternative possibilities for a more inclusive form of governance. – Reproduced https://www.epw.in/journal/2025/39/special-articles/public-law-and-social-exclusion-indigenous-people.html
