The judiciary’s plunge into the legislative domain reflects a constitutional obligation to create an “interim law” where statutory and executive silence imperils procedural fairness and individual rights. However, the directions fall short of prescriptive adequacy and leave unresolved the deeper challenge of evidentiary reliability.
