Taking constantly declining conviction rate as a serious negative indicator of enforcement of law and orders in India, the authors take an analytical look at Indian Criminal Justice System. Finding the system accused-oriented (instead of being victim-oriented as borne out by illustrations given by them, legal process time-consuming, investigation methods faulty, and police-prosecution coordination lacking, they highlight its negative impact on our correctional system, which is getting reflected in overcrowding of jails and deleterious effects thereof. They, therefore, underscore the urgency of remedying these maladies, including a paradigm shift in the system to make it victim-oriented. - Reproduced |
